Binding Agreement: By requesting service, scheduling an appointment, approving an estimate, work order, or invoice, or submitting payment, the customer (“Client”) agrees to the terms below.

1. Scope of Work

  1. The Oven Man LLC (“Technician”) will perform diagnostic, repair, and maintenance services on commercial cooking equipment as requested.
  2. All work will be performed professionally using OEM or OEM-quality parts when available.
  3. Additional parts, labor, or return visits may be required due to equipment condition, access, concealed defects, or parts availability.

2. Labor Rates & Payment Terms

  1. Standard Labor Rate: $150 per hour, portal-to-portal, with a 1.5 hour minimum, unless otherwise agreed in writing.
  2. Emergency / Same-Day Rate: Emergency, after-hours, or weekend service is billed at 1.5× the standard rate.
  3. All invoices are due upon completion of service unless otherwise agreed in writing.
  4. Diagnostic and service fees are non-refundable.
  5. Special-order or high-value parts require a minimum 50% deposit prior to ordering.
  6. Late Payments: Invoices unpaid after 15 days may accrue interest at 1.5% per month (18% annually) or the maximum allowed by law.
  7. Suspension of Service: Service and parts orders may be suspended for past-due accounts.
  8. Collections & Legal Action: Balances unpaid after 30 days may be referred to collections or legal action. Client is responsible for reasonable collection and court costs where permitted.
  9. Chargebacks: Reversed or disputed payments remain the Client’s responsibility, including processing fees.

3. Cancellation / No-Show Policy

  1. Appointments cancelled within 24 hours of scheduled service are subject to a $100 service fee.
  2. Cancellations after technician arrival or refusal of service upon arrival are subject to the same fee.
  3. This fee covers reserved time and travel and is due immediately.

4. Parts & Labor Warranty

  1. OEM parts carry manufacturer warranty only.
  2. Labor is warranted for 30 days and applies only to the original repair.
  3. Warranty excludes misuse, neglect, improper utilities, unrelated failures, or third-party repairs.
  4. Warranty is limited to re-performing covered labor only.

5. Limitation of Liability

  1. The Oven Man LLC is not responsible for business losses, food loss, revenue loss, or downtime.
  2. Not responsible for failures caused by installation issues, code violations, utilities, or third parties.
  3. Total liability is limited to the amount paid for the specific service.
  4. Consequential and incidental damages are excluded where permitted.

6. Service Access & Safety

  1. Client must provide safe access to equipment and utilities.
  2. Service may be refused due to unsafe conditions.
  3. Service charges remain due if unsafe conditions prevent completion.

7. Abandoned Equipment or Parts

Equipment or parts left unclaimed for 30 days after notification may be disposed of or retained as permitted by law.

8. Acceptance

Approval of service, estimates, invoices, or payment confirms agreement to these terms.

Non-payment does not invalidate this agreement.

9. Parts Policy

  1. Parts are sourced from OEM, OCM or approved suppliers.
  2. Installed/opened parts are typically non-returnable.
  3. Defective parts are handled under manufacturer warranty.
  4. Return fees and shipping are the Client’s responsibility.

10. Miscellaneous

  1. Severability: Invalid provisions do not affect remaining terms.
  2. Governing Law: Pennsylvania law governs this agreement.
  3. Venue: Disputes shall be in or near Philadelphia County.
  4. Entire Agreement: This document supersedes prior discussions.
